With regard to an existing Declaration of Covenants, Conditions and Restrictions, the task may only involve a single provision or it may be as extensive as a complete amendment and restatement of an existing Declaration. Amendments and restatements of Declarations for multiple sections in a development often involve the consolidation of all sections so that all sections are governed by a single document. The firm has handled amendments, restatements and consolidations of original restrictions recorded as long ago as the 1930’s and involving as many as 23 sections. Amending Bylaws, Architectural Guidelines and Rules and Regulations are an ongoing function of the firm so that our clients’ governing documents remain current with the law. All governing documents, as well as amendments and supplements to governing documents are recorded in the real property records of the county where the development is located, as required by statute, by virtue of a Notice of Dedicatory Instrument and supplements to the Notice.
